1. Acceptance of the conditions
The customer admits having taken knowledge of the particular conditions of sale stated on this screen and accept them without reserve.
The present general conditions of sale govern the contractual relations between Emoi et moi Japon and its customer, the two parts accepte without reserve. These general conditions of sale will prevail on all other conditions appearing in any other document, except preliminary, express and written exemption.
2. Products
The photographs illustrating the products do not enter the contractual field. If errors were introduced there, in no case, the responsibility for Emoi et moi Japon could not be committed.
3. Order

Emoi et moi Japon confirms the acceptance of the order to the customer with the address mall that this one will have communicated. The sale will be concluded only as from the confirmation of order. 4. Delivery
After confirmation of order, Emoi et moi Japon commits itself delivering to its conveyor, all the references mentioned by the purchaser within 48h working days if the ordered products are in stock, 1 week up to 1 month and half if they are not in stock.
The delivery periods is approximately one week (if ordered products are in stock). The ordered products will be directly sent from Japan to the indicated address. The parcel can however be subjected to customs duties and/or taxes to the importation to its arrival in the country of delivery. The customs duties are not included in the price, and are the responsibility of the purchaser, but it is very rare.
For the deliveries out of the Metropolitan France the customer commits himself regulating all the taxes due to the importation of products, customs duties, value-added tax, and all other taxes due under the terms of the laws of the country of reception of the order. All the placed orders with Emoi et moi Japon are intended to the personal use of the customers, the customers or the product consignees prohibit any partial or total resale products. Emoi et moi Japon releases itself in fact of any legal responsibility if the payment of the taxes were not carried out by the customer.
The delivery is carried out?by the direct handing-over of the product to the delivery address, in the case of absence, to another person is entitled by the customer. The possible delays do not give the right to the purchaser to claim damages.
The deliveries in the countries of the EEC are carried out by the post office in colissimo followed Europe, for the deliveries out of the EEC the deliveries are carried out by the international mail service or Chronopost. In the cases of a technical product, the customer will particularly take care to check the correct operation of the delivered apparatus, with reading the note of employment which is provided to him.
In the event of apparent defects, the purchaser profits from the right to repossess under the conditions envisaged in this document.
Are regarded as case of absolute necessity discharging the salesman from his obligation to deliver, the war, the riot, the fire, the strikes, the accidents and impossibility of being supplied. The goods always travel to the risks and dangers of the recipient. Always check your parcel with the arrival. You have a 48 hours deadline to make possible reserves near the conveyor in the event of lack or degradation.
5. Retractation
You have 7 days (as from the reception of the articles) to make an opinion. In case of exchange or refunding, please let un know initially by e-mail, fax, or telephone. We will communicate you the address to return the products, because the address of supplier is different depending on the products.
The article has to be new in package of origin, intact, accompanied by all the accessories, notes of employment and documentations.
In the event of exercise of the right of retractation, Emoi et moi Japon is held with the refunding of the sums paid by the customer, except for the return fee and the refunding fee (Paypal commision). Refunding is within 15 maximum day.
6. Exchange
We cannot accept the exchange for the special order that is not a stock article.
We accept the exchange only in the case of difference in size.
In this case, please let us know initially by e-mail, fax, or telephone. We will communicate you the address to return the products, because the address of supplier is different depending on the products. The article has to be new in package of origin, intact, accompanied by all the accessories, notes of employment and documentations.
The customer is subjected to the return fee to the shipper, extra charges (ex: importaion taxes, customs duties, etc...) and the re-shipping fee from the shipper (to the customer's address) except for the case of defect of product.
7. Price
The price is expressed in euros and it can change according to the currencies without notice, nevertheless the price remains unchanged once that you ordered.
The indicated price on the document of product include transport.
The indicated price in the confirmation of order is the final price, expressed in H.T. (the importation of Japan) This price includes the price of the products, packing and the conservation handling charges of the products, the transport charges and startup.
8. Payment
The invoiced price with the customer is the price indicated on the confirmation of order addressed by Emoi et moi Japon.
The price of the products is payable the cash the day of the effective order.
The payment is carried out by credit card carrying initials CB.
In Paypal line allows you to regulate via a banking server of Paypal in a protected environment.
Your bank card number is thus directed towards the server of the bank, your payment is carried out directly without passing by the server of the shop (guaranteed all the more important as your Number are known only of our banking partner Mizuho Banque).
The order validated by the customer will be considered effective only when the centers of banking payment concerned give their agreement. In the event of refusal of the known as centers, the order will be automatically cancelled and the customer warned by electronic mail.
9. Litigations
This contract is subjected to the Japanese right. Emoi et moi perhaps held for person in charge for the damage of any nature, as well materials as immaterial or body, which could result from a faulty operation or misuse of the marketed products. It is the same for the possible modifications for the products resulting from the manufacturers. The responsibility for Emoi et moi Japon will be, in any event, limited to the amount of the order and could not be blamed for simple errors or omissions which could have remained despite everything the precautions taken in the presentation of the products. In the event of difficulties in the application of this contract, the purchaser has the possibility, before any action at law, to seek a friendly solution in particular with the assistance:
of a trade association of the branch, an association of consumers or any other council of his choice. One is reminded that the search for the friendly solution does not stop the "short time" of the legal guarantee, nor contractual warranty period. One is reminded that in general and subject to the appreciation of the courts, the respect of the provisions of this contract relating to the contractual guarantee supposes that the purchaser honours his financial commitments towards the salesman.
The complaints or disputes will be always received with benevolence, the good faith being always supposed at that which takes the trouble to expose its arguments. In the event of litigation, the customer will address himself by priority to the company to obtain a friendly solution.
With defect, the Commercial court of CITY is only qualified, whatever the place of delivery and the mode of payment accepted.
10. Guarantee
Emoi et moi Japon guarantees to you that all our articles are made with the hand by creator. In all the cases Emoi et moi Japon could not be held for person in charge for non-observance for the regulations and legislative into force in the country of reception, the responsibility for Emoi et moi Japon is systematically limited to the value for the product blamed, value on its date of sale and this without possibilities of recourse towards the mark or the producing company of the product.
11. Legal information
The information of the personal information collected for purposes of the remote sale is obligatory, this information being essential for the treatment and the routing of the orders, the establishment of the invoices and contracts of guarantee. The defect of information involves nonthe validation of the order. We reserve the right to refuse service to anyone we recognized dishonest by unconsidered request mail.
